DOCKET NO. 03-035-04

REPORT AND ORDER AND
NOTICE OF HEARING

--------------------------------------------------------------------------------

ISSUED: December 8, 2003

By The Commission:

In this matter Dammeron Valley Water Works ("Dammeron Valley") complained that it had experienced damage to its equipment due to electric power supplied by Utah Power and Light ("Utah Power"). On October 22, 2003, this Commission issued an order finding that on at least a few occasions Utah Power's electric supply had failed to comply with applicable standards. We also noted that it appeared that the situation had improved since Utah Power had installed voltage regulators on the line. We ordered further study to obtain more information on what specifically was causing the power problems on the line serving Dammeron Valley. The order also stated that if further problems arose during the study period that they should be brought to the attention of the Commission.

On December 4, 2003, the Commission received two letters from Dammeron Valley, one dated November 28, 2003, and one dated December 4, 2003. In those letters Dammeron Valley states that three more motors have been damaged since the hearing in this matter, and that it has paid over $20,000 in repairs in the previous three months. Dammeron Valley's letters also assert that Utah Power has failed to provide data from power line monitors on this line.

This matter must be addressed immediately. We will therefore set a hearing to discuss the contents of Dammeron Valley's letters, the power quality situation on the line serving Dammeron Valley, and possible remedies and needed actions.

Accordingly, notice is hereby given that a hearing in the above-entitled matter will be conducted by the Administrative Law Judge of the Public Service Commission of Utah on Friday, December 22, 2003, at 11:00 a.m., in the Commission's Fourth Floor Hearing Room #451, Heber M. Wells State Office Building, 160 East 300 South, Salt Lake City, Utah. In compliance with the Americans with Disabilities Act, individuals needing special accommodations (including auxiliary communicative aids and services) during this hearing should notify Julie Orchard, Commission Secretary, at 160 East 300 South, Salt Lake City, Utah, 84111, (801) 530-6713, at least three working days prior to the hearing.

Dated at Salt Lake City, Utah, this 8th day of December, 2003
