NOTICE OF HEARING ON MOTION FOR IMMEDIATE RELIEF AND
DECLARATORY RULING

By The Commission:

On March 23, 2004, Comcast Cable Communications, Inc. (“Comcast”) filed a Motion for Immediate Relief and Declaratory Ruling (“Motion”) in the above-captioned docket on the grounds that PacifiCorp has denied Comcast pole-attachment access in violation of federal and state law. The docket was initiated by Comcast to resolve a rate dispute involving license agreements to permit Comcast to attach its cables to PacifiCorp’s utility poles. In its Motion, Comcast contends that on March 3, 2004, PacifiCorp refused to process any more pole attachment permit applications of Comcast for the state of Utah. Comcast also requests a hearing on the matter.

ORDER

NOW, THEREFORE, IT IS HEREBY ORDERED that the Commission shall hear oral arguments on Comcast's Motion for Immediate Relief and Declaratory Ruling on Tuesday, April 6, 2004 at 9:00 a.m. (MST) in the Commission’s Hearing Room No. 426, 4th Floor, Heber M. Wells Building, 160 East 300 South, Salt Lake City, Utah.

If a party wishes to participate in the oral argument by telephone, it shall notify Julie Orchard, Commission Secretary, at 160 East 300 South, Room 400, Box 45585, Salt Lake City, Utah 84145-0585, Telephone: (801) 530-6713, at least three days in advance of the hearing.
