By The Commission:

On March 24, 2005, following agreement of the parties reached during a technical conference held on March 23, 2005, the Administrative Law Judge issued a Second Procedural Notice requiring Dammeron Valley Water Works (“DVWW”) to file with the Commission by April 22, 2005, its analysis of the Utah Power and Light (“UP&L”) final report filed September 15, 2004. In order to facilitate completion of the DVWW analysis, DVWW was required to submit its consultant’s questions regarding the UP&L final report by April 4, 2005, and UP&L was required to respond to such data requests by April 11, 2005.

The Administrative Law Judge is aware that the parties have generally adhered to the data request and response scheduled outlined in the Second Procedural Notice. However, DVWW has since notified Commission staff that it suffered another pump motor failure on March 23, 2005. According to DVWW, the cause of the motor failure is unknown but DVWW is returning the motor to its manufacturer who has agreed to examine the motor to determine the cause of the failure. DVWW has advised Commission staff that this analysis may take several weeks and has asked that it be granted an unspecified extension to submit its report so that it can include the manufacturer’s analysis of the latest motor failure.

Therefore, based on the foregoing information and for good cause appearing, the Administrative Law Judge hereby grants DVWW’s request for an extension. DVWW’s report shall be filed with the Commission not later than May 23, 2005. Further proceedings in this docket will be scheduled as necessary following filing of the DVWW report.
