The Commission will hold a scheduling conference on Friday, February 18, 2005 at 9:00 a.m. in Room 427 on the Fourth Floor of the Heber M. Wells Building, 160 East 300 South, Salt Lake City, Utah 84111. Individuals wishing to participate by telephone should call in to (801) 530-6716 or call toll-free 1-866-PSC-UTAH (1-866-772-8824) at least five minutes prior to the hearing.
The purpose of the scheduling conference is to set a schedule for proceedings in these dockets, either on a joint basis or individually. In Docket No. 03-035-14, the Commission entered an order, on June 28, 2004, approving a stipulation whereby an interim resolution was presented to deal with some qualifying facilities (QF s) greater than one Megawatt. The purpose was to provide some parameters for dealing with QF matters pending the outcome of a task force tasked to address a number of issues associated with larger QFs. It was anticipated that a final resolution would be made prior to the end of 2004. Since that time, no consensus resolution on the issues has been reached by the task force and it appears that a consensus may not be attainable to address QF matters in a timely fashion.
Lacking a consensus resolution within the time frame previously contemplated, the Commission now believes it appropriate to approach resolution of the issues by the Commission. Circumstances upon which the parties relied in proposing the stipulation in Docket 03-035-14 may no longer be applicable to QF facilities who wish to offer electricity to PacifiCorp. The absence of a consensus resolution from the task force on how larger QFs, who have no contract with PacifiCorp, should be treated now is the genesis of Spring Canyon’s request in Docket 05-035-08 and Pioneer Ridge/Mountain Wind’s request in Docket 05-035-09. Again, the Commission believes it appropriate for the Commission to now address these parties’ matters, as a consensus resolution seems unlikely, and to resolve their disputes with the most current, relevant and applicable information available to us. At this time, the Commission believes that resolution of an issue in one docket will have impact upon the resolutions in the other dockets, this is why we have set a contemporaneous scheduling conference for the three dockets. The Commission contemplates conducting the three proceedings jointly, but desires to hear the parties views on an appropriate process at the scheduling conference.
